TERMS OF SERVICE
Effective Date: July 27, 2026
Welcome to St. Louis Refinishing Pros. By accessing our website, requesting a quote, or engaging our residential refinishing and refurbishing services, you (the "Client" or "User") explicitly agree to be bound by the following Terms of Service, as well as the provisions of our Residential Refinishing Services Agreement. If you do not agree to these terms, please discontinue use of our site and services immediately.
1. Scope of Online & Physical Services
St. Louis Refinishing Pros ("Company") provides informational content on its website and professional refinishing/refurbishing services for residential fixtures (including cabinets, bathtubs, showers, tiles, sinks, and floors). Unless explicitly requested otherwise in writing, all physical finishes are applied in standard bright white.
2. Intellectual Property & Website Use
All content, logos, graphics, photographic portfolios, text, and digital layouts displayed on this website are the sole property of St. Louis Refinishing Pros. Users are granted a limited license to browse the site for personal, non-commercial placement of service requests. Any unauthorized copying, distribution, or scraping of our web assets is strictly prohibited.
3. Data Privacy & Non-Sharing Commitment
Your trust is vital to us. We collect necessary customer information (such as names, addresses, phone numbers, and emails) solely to provide accurate quotes and fulfill our services.
4. Client Responsibilities & Site Preparation
To ensure service quality and technician safety, the Client agrees to the following on-site conditions prior to the technician’s arrival:
Zone Access: All personal items must be removed from the designated project zone. Technicians cannot move furniture, appliances, or heavy fixtures.
Plumbing: Technicians do not perform plumbing work. Toilets, vanities, and shower doors must be removed by the Client or a licensed professional prior to our arrival.
Utilities: The Client must provide operational electricity, running water, and climate control maintained strictly between 68°F and 72°F.
Prep Checklist: Failure to adhere to our Property Manager Prep Checklist may result in a prorated delay fee of $60.00 per hour, or forfeiture of your deposit if the service cannot safely be performed.
5. Lead-Based Paint and Hazardous Material Warning
In compliance with Federal and State regulations, including the EPA’s Renovation, Repair, and Painting (RRP) Rule:
Pre-1978 Structures: If the Client’s residential property was constructed prior to 1978, the pre-existing paint, glaze, or under-layers may contain lead.
Client Disclosure Requirement: The Client is legally obligated to disclose any known lead-based paint hazards before work begins.
Refusal of Unsafe Work: If the Company or its technicians detect or suspect the presence of unstable lead paint or heavily deteriorating hazardous materials that cannot be safely managed via standard refinishing protocols, the Company reserves the right to halt work immediately. The Client will be responsible for standard testing costs or any work completed up to that point. The Company is not an asbestos or toxic lead abatement contractor.
6. Safety, Curing, & Ventilation
The refinishing process involves professional-grade bonding agents and chemical coatings.
Site Separation: The Client agrees to completely vacate the immediate project area during application and ensure continuous ventilation as directed by the technician.
Assumption of Risk: The Client assumes all responsibility for discomfort or standard health sensitivities relating to chemical vapors/refinishing fumes.
Cure Times: Remodeled fixtures must remain completely untouched and dry during the designated cure time specified by the technician (typically 24 to 48 hours). Touching or using the surface early voids all warranties.
7. Payment & Late Fees
Deposits: A non-refundable deposit is required to secure your appointment window.
Final Balance: The final balance is due instantly upon project completion, without exception.
Delinquency: Past-due balances will accrue interest at a rate of 5% per month, or the maximum rate allowed under Missouri law, whichever is lower.
8. Limited Warranty & Exclusions
Standard Warranty: We provide a 1-year limited warranty from the date of completion covering material defects like peeling, blistering, or cracking. Valid warranty issues will be addressed free of charge within 2 weeks of an official report.
Extended Upgrades: Clients may opt into a 5-year ($200) or 10-year ($400) extended warranty protection tier.
Explicit Exclusions: No warranty covers normal wear and tear, physical impacts (dropping sharp/heavy objects), dulling caused by abrasive cleaners, chemical reactions to bath salts, damage from animal claws, suction cups, plumbing leaks, or structural shifts in the property.
9. Limitation of Liability & Non-Defamation
To the fullest extent permitted by Missouri law, the Company’s total cumulative liability for any claims, damages, or property losses arising out of this agreement shall not exceed the exact total price paid by the Customer for the services rendered. The Company, its executives, employees, and independent contractors assume no indemnity for indirect, incidental, or consequential damages.
Review Integrity: The Client agrees to resolve any service discrepancies directly with the Company management and agrees not to post defamatory, false, or malicious statements online pertaining to the technicians or business operations.
10. External Links & Third-Party Platforms
Our website may contain links to external platforms (such as Facebook, Yelp, or Trustpilot). We do not control, endorse, or assume responsibility for the content, privacy policies, or terms of any third-party websites you visit through our external links.
11. Governing Law & Severability
This agreement is constructed under and governed by the laws of the State of Missouri. If any specific clause within these Terms is found invalid or unenforceable by a Missouri court of competent jurisdiction, that specific provision shall be severed, and the remainder of these Terms will continue in full force and effect. Any unresolved contractual disputes shall be handled in the small claims or circuit court of the Missouri county where the refinishing work was performed.
